Woman who contracted STD after janitor put penis in water bottle files lawsuit

A Texas woman who contracted an STD after a janitor allegedly urinated in her water bottle at work has now filed a civil lawsuit in the stomach-churning case — along with three other victims who have also come forward.

The custodian, 50-year-old Lucio Diaz, was arrested this week in Houston and charged with aggravated assault with a deadly weapon.

The victim, who hasn’t been identified, previously told the station KHOU11 she felt “disgusted” after she set up a hidden camera in her office at a medical building and allegedly caught Diaz dipping his manhood into her bottle last month.

Kim Spurlock, the woman’s lawyer, said she filed a civil complaint Thursday on behalf of four plaintiffs, KHOU11 reported.

The suit accuses the owner of the building, the management company and the janitorial company that employed Diaz of failing to properly vet, train and supervise him. It seeks over $1 million in monetary relief.

Spurlock said the woman who recorded Diaz, identified by the initials M.A. in the 16-page complaint, contracted herps from coming in contact with the contaminated water bottle, as did at least one other person.

The lawsuit also alleges that when M.A. raised the alarm about Diaz’s conduct, the building’s management did not address her concerns in a timely manner.

The court filing states that M.A. first noticed that the water in her office on Westmont Dr. was smelling and tasting foul at the end of August. After that, she began bringing her own bottled water from home.

If she didn’t finish her water during the workday, she would leave it on her desk to drink the following day, said the woman, a 54-year-old mother of two.

Before long, the woman began noticing that her water started to smell off too, and a co-worker told her that it looked yellow and reeked of urine.

“I felt disgusted,” the victim, who wished to remain anonymous, told KHOU. “I raised it to my face, smelled it, and it smelled like urine.”

The woman had the liquid tested, and it was confirmed that her water contained urine.

Seeking to unmask the culprit who had been tampering with her water, in late September M.A. installed a hidden camera in her office, which caught Diaz unzipping his pants and inserting his penis into the woman’s water bottle, according to the lawsuit.

The victim, who shared screenshots from the video with KHOU, told the station that it showed Diaz tilting the bottle to make sure his genitals made contact with the water, and then rubbing his privates on the mouth of the bottle, before calmly getting back to work.

“Diaz was not phased, he was not nervous. He had done this before — and it had now become just a part of his daily ‘cleaning’ ritual,” the complaint states.

According to the lawsuit, the victim immediately contacted the police and also the building’s management company, but officials there allegedly waited six days to notify all the tenants of what had transpired.

When Diaz was confronted by cops, he allegedly confessed, claiming he did it out of “malicious intent” and that it was a “sickness.” He claimed he was not aware that he had any STDS, but he later tested positive for the same incurable disease as his victim.
