The Plano woman, who racially attacked two Indian American women late last month, faces lawsuit

PLANO, Texas – A lawsuit has been filed against a lady seen on film screaming racial comments towards a gathering of Indian American ladies.

Bidisha Rudra is suing Esmeralda Upton for causing her mental pain on August 24.

Wednesday night, a Plano woman was arrested on counts of assault and making terroristic threats following an encounter outside of a restaurant. Facebook-posted video proof of the incident has been obtained by the police.

According to the lawsuit, Upton approached Rudra and two of her friends after hearing them speaking in an Indian language outside the Sixty Vines restaurant in Plano.

The social media footage depicts Upton mocking the women, threatening to shoot them, and at one point physically assaulting one of them.

In the video, she is heard saying, “I detest you f***ing Indians!” “Return to India… we don’t want you here.”

Upton was detained by Plano police on suspicion of assault and making terroristic threats. The situation is being investigated as a hate crime.

The woman accused of threatening and abusing a group of Indian women in Plano has been released on bond, but police say the incident is still under investigation.

The lawsuit states that Rudra now fears for her safety in public locations such as restaurants and grocery stores due to Upton’s actions. She supposedly also suffers from severe anxiety, hypertension, and PTSD.

The lawsuit does not specify the amount of damages it seeks. It requests a jury trial in order to hold Upton accountable and send a message that racist and prejudiced assaults will not be allowed.

Upton is currently free on bond from jail.
